These terms govern your use of colist. Please read them carefully. This draft is a placeholder pending final legal review.
By creating an account, listing a property, or otherwise using colist (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
colist is operated by colist, Inc. (“colist,” “we,” “us”). We may update these terms from time to time; continued use after an update constitutes acceptance of the revised terms.
colist is a technology platform that lets homeowners list and market a property for sale directly (“for sale by owner”), including access to valuation tools, comparable-sales data, listing syndication, and buyer-inquiry routing.
colist is not a real estate brokerage and does not represent you as an agent or broker. We do not provide legal, tax, financial, or brokerage advice. You are responsible for complying with all laws applicable to the sale of your property and for engaging your own professionals where appropriate.
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information in your account and for keeping your credentials secure.
You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use.
Paid plans are billed at the prices shown at checkout. Fees are charged through our third-party payment processor and are non-refundable except where required by law or expressly stated at the time of purchase.
Listing periods, plan features, and pricing are described on our pricing page and are subject to change for future purchases.
You represent that you have the right to sell the property you list and to upload any photos, descriptions, or other content. You are solely responsible for the accuracy and legality of your listing content.
You agree not to post content that is false, misleading, discriminatory, or that violates fair-housing, advertising, or any other applicable law. We may remove content or suspend a listing that we reasonably believe violates these terms.
Where offered, colist may syndicate your listing to a multiple listing service (MLS/RLS) and downstream portals. Syndication is subject to the rules of the applicable MLS, which may impose requirements on listing data, media, and conduct.
You authorize colist to submit your listing information to these services on your behalf and to correct or withdraw it as required by MLS rules or your instructions.
The Service integrates third-party providers for property data, communications, payments, and authentication. Valuation and comparable-sales figures are estimates provided for informational purposes only and are not appraisals or guarantees of value or sale price.
Your use of a third-party integration may also be subject to that provider's own terms.
You agree not to misuse the Service, including by attempting to access it without authorization, scraping or reverse-engineering it, interfering with its operation, or using it to send spam or unlawful communications.
colist and its licensors own the Service, including its software, design, and trademarks. You retain ownership of the content you submit and grant colist a license to host, display, and syndicate it for the purpose of operating the Service.
The Service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, colist is not liable for indirect, incidental, or consequential damages, and our total liability arising out of the Service is limited to the amount you paid us in the twelve months preceding the claim.
Nothing in these terms limits liability that cannot be limited under applicable law.
You may stop using the Service at any time. We may suspend or terminate access if you violate these terms or if necessary to protect the Service or other users. Certain provisions survive termination, including ownership, disclaimers, and limitation of liability.
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. We will post the effective date of any material change at the top of this page.
